Terms and Conditions

1. Scope and Contracting Party

These terms apply to all orders placed via www.bacto-clothing.com.

The contracting party is BACTO GesbR, Josef-Pohler-Weg 5, 6600 Reutte, Austria, VAT ID ATU79119446, email info@bacto-clothing.com.

Deviating terms and conditions of the customer shall only apply if we agree to them in writing.

2. Formation of the Contract

The presentation of products in the shop does not constitute a legally binding offer, but rather an invitation for you to place an order.

By sending the order, you submit a binding offer. The automatic order confirmation sent via email confirms only that your order has been received by us — it does not yet constitute acceptance. The contract is concluded as soon as we expressly declare acceptance or ship the goods.

If, contrary to our listing, an item is no longer available or a price was obviously incorrectly labeled, we may reject the order. In this case, we will refund any payments already made immediately and in full.

We store the contract text and send it to you with the order via email. Orders can be placed in German.

3. Prices, Shipping Costs, and Customs

All prices are in Euros and include statutory VAT.

Shipping costs depend on the delivery country. They are calculated during the checkout process and clearly displayed before you submit your order. You will not be charged any costs that were not displayed to you beforehand.

For deliveries outside the European Union, additional customs duties, import VAT, and processing fees charged by the delivery service may apply. These amounts are to be borne by the customer. They are not charged by us but directly by the delivery service or the customs authorities of the destination country, and we cannot estimate their amount in advance.

4. Payment

We accept:

  • Credit and debit cards via Shopify Payments: Visa, Mastercard, American Express, Maestro, UnionPay
  • Shop Pay
  • Apple Pay
  • Google Pay
  • PayPal

Payment is due upon completion of the order. The checkout process will show you which payment methods are available in individual cases.

5. Delivery

The delivery time is 3 to 12 working days from receipt of payment. We ship worldwide. Shipping is handled by DPD.

If an item is not available, we will inform you immediately and refund any payments already made without deduction.

6. Right of Withdrawal

Consumers are entitled to a right of withdrawal of 14 days. Details, deadlines, and the model withdrawal form can be found in our Cancellation Policy.

On every page of our shop, you will also find a "Cancel contract" button, which you can use to declare your withdrawal directly online.

7. Warranty

The statutory warranty provisions of §§ 922 et seq. of the Austrian Civil Code (ABGB) and the Consumer Warranty Act apply. The warranty period is two years from delivery and is not restricted for consumers.

Please report any defects to info@bacto-clothing.com — preferably with a photo and your order number to speed up the process.

Normal wear and tear as well as damage caused by improper handling or failure to follow care instructions are not considered defects.

8. Choice of Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

This choice of law does not deprive consumers of the protection of mandatory provisions that apply in the country of their habitual residence.

For legal action against consumers, the court at the place where the consumer has their residence, habitual abode, or place of employment has exclusive jurisdiction (§ 14 KSchG).
